Copies of records relating to the Pioneering Public-Private Partnerships (Pioneering PPP) including:
(i) All reports created by the inter-departmental task team who were mandated by cabinet in 1997 to develop a package of policy, legislative and institutional reforms to create an enabling environment for Public-Private Partnerships.
(ii) A comprehensive list of all the Pioneering PPP projects during the period between 1997 to 2000 which reflects who was the private partner, the BEE percentage of equity and sub-contracting, the financing and arrangers, the transaction advisors to government and the value to government.
(iii) The policy and legislative framework within which the Pioneering PPP projects operated in.
(iv) The procurement framework with which these Pioneering PPP projects were awarded.
(v) The feasibility studies that were conducted with respect to the Pioneering PPP.
(vi) The consessionary contracts that were entered into between the various departments and the private partner with respect to the Pioneering PPP.

For records related to the use of restraints when detaining prisoners, specifically, copies are requested of:

(i) A list of the make and model of any electronically activated high-security transport stun belts used in terms of Regulation 18(1)(e) of the Correctional Services Act.

(ii) A list of the make and model of any electronically activated devices used in terms of Regulation 19(1)(b) of the Correctional Services Act.

(iii) Any internal memo or policy document indicating which rank or position within the Department of Correctional Services empowers an individual to use electronically activated high-security transport stun belts, in terms of section 31 of the Correctional Services Act

(iv) Any internal memo or policy document indicating which rank or position within the Department of Correctional Services empowers an individual to use electronically activated non-lethal incapacitating devices, in terms of section 33 of the Correctional Services Act.

Copies of records relating to the Mangaung Correctional Centre (MCC). Specifically, copies are requested of:

(i) Any and all records prepared as part of the feasibility study conducted for the National Treasury in terms of Treasury Regulation 16.4.2 as part of the application for Treasury Approval: I.

(ii) The bid documents prepared for the National Treasury in terms of Treasury Regulation 16.5.1 as part of the application for Treasury Approval: IIA.

(iii) The value for money report prepared for the National Treasury in terms of Treasury Regulation 16.5.4 as part of the application for Treasury Approval: IIB.

(iv) The draft and/or finalised PPP agreement prepared for the National Treasury in terms of Treasury Regulation 16.6.1 as part of the application for Treasury Approval: III.

(v) The PPP management plan prepared for the National Treasury in terms of Treasury Regulation 16.6.1 as part of the application for Treasury Approval: III.

(vi) The Concession Contract entered into between the Department of Correctional Services and the Bloemfontein Correctional Contracts (Pty) Ltd (BCC).

(vii) The report authorised by former Correctional Services Minister Sbu Ndebele in 2013 into alleged abuse of inmates by warders of the Mangaung Correctional Centre.

Interim and Final Reports into Magaung Correction Centre

On 26 August 2014, the Centre for Applied Legal Studies lodged (CALS) a request for the Department of Correctional Services’ interim report on its investigation into the Mangaung Correction Centre in 2013 that preceded the takeover of the Centre by the Department in October 2013. Cals also requested the response of the Bloemfontein Corrections Contract (BCC) to the interim report.
In this PAIA application CALS now requests:
1. A copy of the G4S response to the interim report; and
2. The final version of the report.
