4. Records reflecting the current price at which Kelvin produces electricity;
5. Records reflecting the current price at which Kelvin sells electricity to City Power;
6. A copy of the contract between Kelvin and City Power regarding the supply of electricity;
7. Records reflecting the current price Kelvin pays for the water it receives from the City of Johannesburg (CoJ);
8. Records reflecting the amount of water Kelvin receives from the CoJ;
9. A copy of the contract between Kelvin and the CoJ regarding the supply of water;
10. A copy of Kelvin’s decommissioning plan, including the records reflecting the dates when the decommissioning process and the required environmental impact assessment (EIA) process is planned to start;
11. The current atmospheric emission licence (AEL) for Kelvin issued by Ekurhuleni Metropolitan Municipality if this is different from the AEL issued under number 14/1/1/7/1/66/Kelvin/Kemp, apparently signed by the air quality officer on 18 September 2013;
12. The current water use licence (WUL) issued by the then Department of Water Affairs (DWA) if this is different from the WUL issued under number 03/A21C/FGH/1110, and apparently signed on 24 June 2011 by the then Acting Director-General of the DWA;
In terms of the AEL:
13. the monthly monitoring reports from April 2015 to date of responding to this PAIA request;
14. the most recent annual emission report;
15. the most recent annual report (if this is a different record from the annual emission report);
16. Kelvin’s emission reduction plan to ensure compliance with the emission standards in the AEL, as well as with the new plant minimum emission standards from 1 April 2020, providing a detailed outline of how Kelvin will achieve compliance;
17. the fugitive emissions/dust management plan;

18. the noise management plan;
19. the reports on the investigations required in terms of condition 7.5;
20. the complaints register;
21. the monthly reports on complaints from 1 April 2015 to date of responding to this PAIA request;
In terms of the WUL:
22. the most recent internal compliance audit report;
23. the most recent external compliance audit report;
24. all results of the analysis conducted of the water balance in the last year;
25. the most recent report on the results of the analysis of the water requirements;
26. the stormwater management plan and “plan for polluted stormwater system”;
27. all accurate and up-to-date records of all system malfunctions in non-compliance with the WUL in the last year;
28. all action plans submitted to address incidents of potential pollution/health risks in the last year;
29. the most recent Integrated Waste and Water Management Plans and Rehabilitation Strategy and Implementation Programmes;
30. the groundwater impact study;
31. the waste minimisation and management programme;
32. the rehabilitation and bio-remediation plan;
33. all surface water monitoring results and reports for the last year;
34. all biomonitoring results and reports for the last year;

A copy of the inspection report compiled by Department of Mineral Resources (DMR) Officials, including Mr Teddy Baloyi, and Mr Redwin Tshisundzugwa - an Environmental Mineral Resource Inspector - following a site visit and inspection of the Vlakvarkfontein Colliery owned by Ntshovelo Mining Resources (Pty) Ltd (Ntshovelo) in Arbor near Delmas, Mpumalanga Province on or about 18 May 2016.

2. A copy of the report presented by the DMR to the Management of the Vlakvarkfontein colliery at a meeting held on 22 June 2016 at the Vlakvarkfortein colliery Boardroom, Arbor, Mpumalanga province.

3. A copy of any and all directives issued by the DMR to Ntshovelo pursuant to the inspection on or about 18 May 2016, or other inspection over the period January 2016 to date hereof.

2. The total number of ivory pieces held by all entities in point 1 above.
3. The weight of ivory above divided between:
3.1 that arising from natural mortality and culling which may one day be eligible for sale, and
3.2 that arising from confiscations of illegal ivory which may not be available for sale.
4. Are all pieces clearly marked to identify their origin as listed in point 3 above, and are these markings recorded in registers? If so, please provide copies of all the register entries that make up the total weight and number referred to in points 1 and 2 above.
