FSE: TCTA and CRG Agreement
In respect of the management plan for extracting water from the Central Basin presented on 7 September 2011 to the Government’s Portfolio Committee on Water and Environmental Affairs by the Trans-Caledon Tunnel Authority, the state-owned entity, established in terms of Government Notice No 2631 in Government Gazette No 10545, dated 12 December 1986 and replaced by Government Notice 277 in Government Gazette No 21017 dated 24 March 2000, promulgated in terms of the National Water Act, 1988 (hereinafter referred to as the “Trans-Caledon Tunnel Authority”), the following records are requested:
1. The draft agreement entered into between the Trans-Caledon Tunnel Authority and Central Rand Gold Limited (with registration number 20017/019223/10, incorporated in Guensey) and/or Central Rand Gold South Africa (Pty) Ltd (with registration number 2005/019355/07) and/or any subsidiary or holding company of the aforementioned (hereinafter referred to as “Central Rand Gold”), pertaining to the purchase of the water pumps that are to be used to extract water from the Central Basin;
2. AND the draft agreement entered into between the Trans-Caledon Tunnel Authority and Central Rand Gold setting out which party will be liable for any or all additional costs associated with pumping water from a level lower than the established critical level.
