SAHA parliamentary and amicus Submissions
SAHA has been invited on occassion to render submissions on various matters in a variety of capacities. The submissions range from court papers as amicus to those proceedings to critical commentary on new legislation. What follows is a list of submissions made to date by SAHA either in its personal capacity or as a member of a civil society network:
Mail & Guardian Centre for Investigative Jounalism v Minister of Public Works Case No. 67574/12
SAHA served as amicus curia in the Mail & Guardian Centre for Investigative Journalism's (amaBhungane) court application, brought to force the Department of Public Works to release records on the upgrading of the President's Nkandla Homestead under a PAIA request. In April 2014 the North Gauteng High Court in Pretoria ordered the department to provide amaBhungane with the records requested - View the Heads of Argument submitted by SAHA
Brummer v Minister for Social Development and Others [2009] ZACC 21
SAHA was not involved in this case due to any particular PAIA request, but acted as first amicus in order to alert the court of the difficulties of trying to apply to court within the thirty days required by PAIA.
Heard on 26 May 2009, the applicant was successful in the Constitutional Court and the period was extended to 180 days to assist parties in coming to court after the stage of internal appeal - View the Heads of Argument submitted by SAHA
