Request for WULs, EAs/RoDs, AELs, WMLs and corresponding compliance and monitoring reports with respect to Rooiwal and Pretoria West power stations
Copies of the following records are requested:
1. In respect of both Rooiwal and Pretoria West power stations:
1.1. the applicable water use licences (WULs) in terms of the National Water Act 36 of 1998 (NWA); alternatively, the applicable permits in terms of the Water Act 54 of 1956 (Water Act);
1.2. all monitoring reports submitted for the last three years in terms of the relevant WULs or permits;
1.3. the last three internal legal compliance audit reports in terms of the NWA or Water Act; and
1.4. the last three external legal compliance audit reports in terms of the NWA or the Water Act;
1.5. the applicable environmental authorisations issued in terms of National Environmental Management Act 107 of 1998 (NEMA);
alternatively, if one or both of the above-mentioned stations does not have a NEMA environmental authorisation:
1.5.1 the applicable records of decision issued in terms of the Environment Conservation Act 73 of 1989 (ECA);
1.6. the applicable waste management licences (WMLs) in terms of the National Environmental Management: Waste Act 59 of 2008, including for ash management;
alternatively, if one or both of the above-mentioned stations does not have a WML:
1.6.1 the applicable waste permits in terms of ECA;
1.7. all monitoring reports submitted for the last three years in terms of the relevant WMLs or ECA permits;
1.8. the last three internal legal compliance audit reports in terms of the Waste Act or ECA ;
1.9. the last three external legal compliance audit reports in terms of the Waste Act or ECA;
1.10. the applicable Atmospheric Emission Licences (AELs) in terms of the National Environmental Management: Air Quality Act 39 of 2004;
alternatively, if the AELs have not been granted for one of both of the above-mentioned power stations:
1.10.1 the applicable Atmospheric Pollution Prevention Act 45 of 1965 (APPA) registration certificates; and
1.10.2 the pending applications for AELs;
1.11. the most recent annual reports reporting on compliance with the AELs submitted to the Gauteng Department of Agriculture and Rural Development (GDARD) ;
alternatively, if there has not yet been a report on compliance in terms of the relevant AELs (or either of the AELs has not yet been granted):
1.11.1 the most recent APPA registration certificate compliance reports.
